To set aside the common fair and decreetal order dated 31.07.2017 and made in HMOP No.76 of 2017 on the file of Family Court, Sivagangai, allow this appeal. COMMON ORDER : These Civil Miscellaneous Petitions coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.S.SRINIVASA RAGHAVAN, Advocate for the petitioner in all CMP's, the court made the following order:- The petitioner has filed a petition for divorce in H.M.O.P.No.76 of 2017 against his wife before the Family Court, Sivagangai. The said petition was dismissed against which, the petitioner has filed the above appeal. Pending appeal, the respondent / wife died.

2.It is the petitioner / husband who has filed a petition for divorce. Since the sole respondent had died pending appeal, nothing survives in the appeal and the present petitions are unnecessary.
