PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records of the Impugned online rejection order in application No.2025/0103/34/453219 dated 13.05.2025 issued by the respondent and to quash the same as illegal and consequently directing the respondent to mutate the petitioner's name in the land in Survey No.1119/21, 1119/22, 1119/23 situated at Kaarisathan Village, Tiruvenkadam Taluk, Tenkasi District.

ORDER

An order dated 27.05.2025 rejecting the petitioner's application for patta is assailed in this writ petition.

2.By relying inter alia on the sale deed executed by one Seenivasagam and settlement deed dated 30.05.2015, the petitioner had applied for mutation of patta Nos.842 and 874. The said request was rejected by the order impugned herein.

3.Learned Additional Government Pleader accepts notice for the sole respondent. He has placed on record the written instructions providing the reasons for rejection.

4.On perusal of the impugned order, it is clear that the only reason recorded in the impugned order is objections by the siblings of the petitioner. There is nothing in the order to indicate the nature of objections raised by the petitioner's siblings. Consequently the order does not meet the requirements of a speaking order and is hereby set aside.

5.As a corollary, the matter is remanded for reconsideration by the Tahsildar. Such reconsideration shall be undertaken after providing a reasonable opportunity to the petitioner, the petitioner's siblings and the Pattadhar concerned. A speaking order shall be issued within twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, connected writ miscellaneous petition is also closed.
