ORDER

This Criminal Original Petition is filed seeking to quash the FIR in Crime No.582 of 2025, dated 26.08.2025, on the file of the first respondent Police, which was registered for the offences under Sections 331(3) and 305 of BNS, 2023.

2. The allegation against the petitioner is that he has trespassed into the house of the defacto complainant and stolen money, which was kept inside the cupboard and thus, committed the aforesaid offence.

3. The learned counsel for the petitioner and the learned counsel for the defacto complainant/the second respondent would submit that the parties are known to each other and that the petitioner is not an habitual thief. He would further submit that the parties have now entered into a compromise on the advise of the elders and well-wishers and both the parties have agreed that the impugned F.I.R may be quashed. 4.The parties have also filed a joint compromise memo dated 22.09.2025. The scanned copy of the compromise memo reads as follows:

5.The petitioner, namely, Deepakrajan (Aadhaar No.9931 8508 5258) and the second respondent, namely, Kanagarajan (Aadhaar No. 9183 0399 8755) are present before this Court in person. They are identified by Ms.M.Pandiammal, Sub Inspector of Police, Anna Nagar Police Station, Madurai District. All the parties confirmed the compromise arrived at between them.

6.Considering the nature of the offences and the relationship between the parties and the fact that the parties have arrived at a compromise, this Court is of the view that no useful purpose would be served by keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.582 of 2025, dated 26.08.2025, on the file of the first respondent police, is quashed. The petitioners shall pay a sum of Rs.10,000/- to the Mediation and Conciliation Centre attached to this Bench, forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. Accordingly, this Criminal Original Petition stands allowed. Consequently, connected miscellaneous petition is closed.
