PRAYER:- Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st respondent to issue the genuineness verification order in respect of the petitioner's ST Kattunayakkan Community Certificate No.173260, on the basis of the community certificate genuineness declaration report issued to the petitioner's father by the Tamil Nadu State Level Scrutiny Committee in Proceedings no. 20696/CVIII/2008-12 dated 24.12.2010. ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) Read this order in continuation of and in conjunction with order dated 11.09.2025, which reads as follows: "2.The petitioner claims to belonging to the Kattunayakkan Scheduled Tribe Community. She has completed her 12th Standard and participated in the NEET examination securing 318 marks in the Scheduled Tribe category. She has completed her MBBS course from the Madurai Medical College and has thereafter appeared in NEET examination for Post Graduate studies.

3.While so, she had filed WP(MD)No.20992 of 2025 seeking a mandamus directing R4 to return original certificates that were being held by the College being (i) 12th Standard Marksheet, (ii) Community Certificate, (iii) Provisional Certificates - I and II, (iv) Degree-cum-Conduct Certificate, (v) Internship Completion Certificate and (vi) Academy Record Book. 4.In the course of hearing of that writ petition, a dispute arose in regard to the community certificate. The father of the petitioner held a community certificate dated 23.02.2011 issued by the Revenue Divisional Officer confirming that he belongs to the Kattunayakkan Scheduled Tribe Community. That certificate had been issued after due enquiry.
5.While so, Mr.Maharajan now refers to a communication dated 24.12.2010 casting a doubt upon that certificate which communication was never placed by the respondents before the writ Court.
6.The writ Court noticed an order passed on 26.11.2019 by the State Level Scrutiny Committee calling upon the Revenue Divisional Officer, Madurai to cause enquiry regarding the correctness and genuineness of the certificate issued to the petitioner's father on 23.02.2011.
7.That order was challenged by the writ petitioner in WP(MD)No.403 of 2020, which was allowed on 24.02.2021. The Division Bench ordered that, following the dictum of orders passed in other matters on identical lines, the respondents will be restrained from conducting any enquiry into the veracity of the petitioner's community certificate. However, nothing prevented the respondents from ascertaining the veracity of her father's community certificate. Consequently, any change in his community certificate would also have a consequential repercussion on the community certificate of the petitioner. Order dated 24.02.2021 passed in WP(MD)No.403 of 2020 has admittedly become final as confirmed by Mr.Maharajan. 8.In such circumstances, there is no doubt in regard to the position that the writ petitioner holds, as on date, a valid 3/7
community certificate to the effect that she belongs to Kattunayakkan Scheduled Tribe community.
9.Despite the same, it is the contention of the petitioner, that R4 is still holding on to the original certificates and the contempt petition that she has filed seeking to enforce the directions under order dated 01.08.2025 has been listed for hearing only on 18.09.2025.
10.In the meanwhile, the counselling for the Post Graduate course is scheduled to take place between 09.09.2025 and 16.09.2025 necessitating the petitioner to approach this Court by way of the present writ petition seeking a mandamus directing the State Level Scrutiny Committee, Chennai to issue a genuineness verification order in respect of the petitioner's community certificate bearing No.173260 dated 23.02.2011. 11.List this matter on 25.09.2025. Counters by then with an advance copy served upon the petitioners.
12.In the meanwhile, the petitioner is permitted to go to the Madurai Medical College as and when she is called to attend the counselling session and certificate verification. The certificates shall be given to her temporarily, to enable her to upload her registration for the counselling session within the college premises itself, upon completion of which, the certificates shall be handed back to R4. R4 shall ensure that the certificates are made available to her at the time of the counselling session and the certificate verification process, and shall retain the same/transfer the same back to the Medical College, post the verification process.
2.Learned counsel for the petitioner would state that the directions have been complied and the petitioner was permitted to participate in the counselling. That apart, proceedings dated 24.09.2025 4/7
are produced before us, whereunder after verification of the records and documents, community certificate to the effect that the petitioner belongs to Hindu Kattunayakan Schedule Tribe Community [Certificate No. 173260], has been issued to the petitioner.
3.As the purpose of writ petition is achieved and recording the aforesaid, this writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed.
