PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Declaratory Mandamus, to hold that the sale agreement registered by 3rd respondent bearing Document No. 4377 of 2022 dated 12.09.2022 is illegal, null and void and to direct the 3rd respondent to 1/5

cancel the sale agreement bearing Document No. 4377 of 2022 on the file of 3rd respondent, dated 12.09.2022, executed by respondents 4 to 6 in favour of 7th respondent in respect of the property of the petitioner and thereby not to register any sale deed.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Declaratory Mandamus, to hold that the sale agreement registered by 3rd respondent bearing Document No. 4377 of 2022 dated 12.09.2022 is illegal, null and void and to direct the 3rd respondent to cancel the sale agreement bearing Document No. 4377 of 2022 on the file of 3rd respondent, dated 12.09.2022, executed by respondents 4 to 6 in favour of 7th respondent in respect of the property of the petitioner and thereby not to register any sale deed. 2.Pending the writ petition, the petitioner has already filed a suit for appropriate remedy. Hence, nothing survives for adjudication. 3.There is another writ petition in W.P.(MD)No.15951 of 2025, wherein this 2/5

Court has already granted an interim protection to the petitioner, vide order, dated 12.06.2025 and the relevant portion of the said order is extracted hereunder: "4. This Court is unable to accept the said contention since the respondents may encumber the property, thereby affecting the rights of the petitioner. Therefore, there shall be an order of interim injunction against the respondents 2 and 3 from entertaining any such application presented by the respondents 4 to 7 in respect of the subject property." Therefore, the petitioner is protected by the above said order. 4.Hence, the present Writ Petition is closed. Consequently, connected Miscellaneous Petitions are closed.
