ORDER

This petition has been filed seeking to quash the impugned FIR in Crime No.315 of 2023 on the file of the 1st respondent police. 2.The contention of the petitioner is that based on the complaint lodged by the 2nd respondent, the 1st respondent registered the First Information Report in Crime No.315 of 2023 for the offences punishable under Sections 21(1) of Mines and Mineral (Development and Regulation) Act, 1957 and under Section 379 of IPC, against the petitioner.

3.This petition has been filed on the ground that this petitioner is not involved in the above said occurrence. He is only owner of property. He along with first accused moved anticipatory bail. The first accused was considered and so far this petitioner, it was dismissed by the order dated 03.10.2023 in Crl.O.P.(MD).No.17574 of 2023, considering the fact that the petitioner is involved in three previous cases. 4.Whether or not he is involved in this case, it is matter for 2/4

investigation. Investigation is in initial stage, it does not requires interference at this stage. Investigation may be taken to its logical conclusion. The petitioner can workout his remedy through appropriate proceedings, if aggrieved over the out come.

5.Accordingly, this criminal original petition stands dismissed. Consequently, connected miscellaneous petition is closed. 10.11.2023 NCC :
