O R D E R
(Order of the Court was made by G.K. ILANTHIRAIYAN,J.) The petitioner is the mother of the detenu viz., Murugavel, son of Pitchai, aged about 36 years. The detenu has been detained by the second respondent by his order in S.R.No. 39/S.O/2025, dated 22.08.2025 holding him to be a "Sexual
Offender", as contemplated under Section 2(ggg) of Tamil Nadu Act 14 of 1982. The said order is under challenge in this habeas corpus petition.
2. We have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. We have also perused the records produced by the Detaining Authority.
3. The learned counsel for the petitioner raised a ground that the detenu was arrested and remanded to judicial custody on 18.07.2025, but the detention order was passed only on 22.08.2025, therefore, there is no live and proximate link between the date of arrest and the date of the detention order.
4. On perusal of the records and also on the counter filed by the second respondent, it is revealed that the detenu committed
very serious and heinous offence as against the mentally disabled girl by committing rape. The investigating officer should have recorded the statement of the mentally disabled person and also subjected her to a medical examination. Hence, there was a delay in collecting the materials to sponsor the detenu's name for detaining him under Act, 14 of 1982.
5.In view of the above, this habeas corpus petition is dismissed.
