The present Writ Petition has been filed by a Junior Assistant working in the respondent Corporation seeking a mandamus as against the respondents 1 and 2 to pass final orders based upon the recommendation made by the third respondent on 01.09.2023 relating to the re-fixation of the seniority of the petitioner and as a consequence, the petitioner has also sought to promote him as Assistant.

According to the learned counsel appearing for the writ petitioner, though the third respondent has recommended for re-fixation of seniority, keeping the said recommendation pending, the respondents 1 and 2 are attempting to effect the promotion to the juniors of the writ petitioner. Hence, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

In view of the above said facts, the first respondent herein is directed to consider the recommendation of the third respondent, dated 01.09.2023 on merits, relating to the re-fixation of the seniority of the petitioner and pass orders before effecting promotion to others within a period of four weeks from the date of receipt of copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
