ORDER

This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner by inducing the petitioner to pay the amount to the third respondent and thereby conducting the illegal Kattapanchayat for the money dispute.

2. The petitioner had sent a representation on 13.11.2024 to the first respondent alleging that at the instance of one R.M. Ananth Babu the respondent police are calling him for enquiry and causing harassment. But on the representation no action has been taken, hence the above petition.

3. The case of the petitioner is that on 11.12.2024 the petitioner was informed by the Vilakutoon police to appear for enquiry on 13.11.2024 and the petitioner appeared . At that time he came to know that one R.M. Ananth Babu had lodged complaint against the petitioner. The said R.M. Ananth Babu is the owner of RSR traders whole sale rice merchant. The petitioner is running a rice mill and the petitioner had some business transaction with RSR traders and there was some dispute between them which was explained to the respondent police and further it is a business transaction hence the respondent police has nothing to do with the dispute between the Ananth Babu and the petitioner. 2/5

4. The learned Additional Public Prosecutor submitted that on the complaint of one R.M. Ananth Babu CSR No. 352/2024 assigned and the petitioner was called for enquiry. Both appeared and gave a statement to resolve the issue and report and for reporting settlement enquiry was adjourned to 21.11.2024. In the meanwhile the petitioner had approached this Court stating that he has been harassed.

5. It is seen that the petitioner was summoned for enquiry in CSR No.352 of 2024 which cannot be termed as harassment.

6. In view of the same the petitioner is directed to appear before the respondent police for enquiry and co-operate with the enquiry.

7. With the above direction, the Criminal Original Petition stands disposed of.
