ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 409 and 420 of IPC, in Crime Nos.17 and 18 of 2022, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that this petitioner served as Accountant in the District Treasury Office, Ramanathapuram from 04.06.2018 to 23.09.2020. The allegation against the petitioner is that he prepared forged ATBPS list and thereby misappropriated the Government Funds to the tune of Rs.1,88,74,719/- through IFHRMS application. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and a false complaint has been given against the petitioner. He would further submit that the petitioner is ready to abide by any stringent condition and he would seek for anticipatory bail.

4.The learned Government Advocate (Crl. side) would submit that the petitioner has misappropriated the Government funds to the tune of Rs.1,88,74,719/- Hence, he vehemently opposed for grant of anticipatory bail.

5.Heard both sides and Perused the materials available on record including the First Information Report. 6.Taking into consideration the facts and circumstance of this case and also considering the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petitions are dismissed. sd/- 01/02/2023 / TRUE COPY / /02/2023 Sub-Assistant Registrar (C.S.)
