O R D E R This Criminal Original Petition is filed to transfer the investigation in CSR No.1135 of 2023 on the file of the 3rd respondent to 2nd respondent in order to conduct proper investigation and to cull out the truth.

2. The learned counsel for the petitioner would submit that even though survey was undertaken with consent of the Police officer, fencing was also put up. Thereafter, the private respondents damaged the above said fencing.

3. The learned Government Advocate (Crl.Side) would submit that on the basis of the complaint given by the petitioner, enquiry was undertaken. During the course of enquiry, both sides appeared and finding that it is a civil issue between the parties, it was closed, advising the parties to workout their remedy through appropriate civil process.

4. If it is further development in subsequent cause of action, the petitioner can file a seperate complaint before the second respondent Police. The second respondent shall enquire the above said complaint on its own merits, if it is so.

5. With the above said direction, this Criminal Original Petition is disposed of.
