ORDER

In Crl.O.P(MD)No.15355 of 2025, the petitioner seeks quashing of the impugned charge sheet in C.C.No.142 of 2022, on the file of Additional Mahila Court, Sivagangai, for the alleged offences under Section 294(b), 324, 506(2) of the IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002.

In Crl.O.P(MD)No.15374 of 2025, the petitioners seek quashing of the impugned charge sheet in C.C.No.33 of 2025, on the file of Additional Mahila Court, (JM Level) Sivagangai, for the alleged offences under Section 294(b), 323, 324, 506(2) of the IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002.

3. The allegation in the final report is that on account of prior enmity, due to misunderstanding between the husband and wife, the petitioners had abused the defacto complainant and his wife besides attacking them and thus committed the aforesaid offences.

4. The learned counsel for the petitioners in both cases would submit that the defacto complainant in one case is the accused in the other case; that the dispute is essentially between the family members of the husband and wife; and pursuant to the advise of the elders, the parties have entered into a compromise and filed a separate joint compromise memo in both cases.

7. The petitioners namely Ramanathan (in Crl.O.P(MD)No.15355 of 2025), Selvam and Alamelu (in Crl.O.P(MD)No.15374 of 2025) and the second 7/10

respondent namely Selvam (in Crl.O.P(MD)No.15355 of 2025) and Annapoorani (in Crl.O.P(MD)No.15374 of 2025) are present before this Court in person. They are identified by Mr.P.Periakaruppan, Special Sub Inspector of Police, Madaguptti Police Station, Sivagangai District. All the parties confirmed the compromise arrived at between them.

In view of the same and considering the nature of the offences and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned charge sheets pending. Accordingly, the impugned charge sheets in C.C.Nos.142 of 2022 and 33 of 2025 are quashed and the Criminal Original Petitions stand allowed. 17.09.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No Sn To 1.The Additional Mahila Court, Sivagangai.
