PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order passed by the third respondent vide his proceedings in Moo.Moo. (A1)/3218/2024 dated 01.10.2024 and the consequential Memo issued by the fourth respondent in his proceedings in Na.Ka.No.A4/2607/2024 dated 25.10.2024 and quash the same as illegal and consequently, to direct the third respondent to pass orders on the appeal filed by the petitioner dated 20.02.2024, within the period that may be stipulated by this Court. ORDER
This Writ Petition has been filed seeking to quash the order passed by the third respondent vide his proceedings in Moo.Moo.(A1)/3218/2024 dated 01.10.2024 and the consequential Memo issued by the fourth respondent, in his proceedings in Na.Ka.No.A4/2607/2024 dated 25.10.2024 and consequently, to direct the third respondent to pass orders on the appeal filed by the petitioner dated 20.02.2024.
2. Heard the learned counsel appearing for the parties.
3. According to the petitioner, the impugned order and consequential memo are unsustainable in law, since the same have been passed without proper consideration of the petitioner's pending statutory appeal dated 20.02.2024. The petitioner contends that the third respondent is bound to consider and dispose of the statutory appeal on merits, but has failed to do so, resulting in prejudice to the petitioner. The petitioner, therefore, seeks quashing of the impugned order and consequential memo, and a direction to the third respondent to pass appropriate orders on the petitioner's appeal dated 20.02.2024, within a time frame to be fixed by this Court.
4. The learned Special Government Pleader for the respondents 1 to 5 objected to allowing the writ petition mainly on the ground that the appeal papers were not filed in the typed set of papers.
5. At this juncture, the learned counsel for the petitioner submits that the petitioner intends to file a fresh appeal.
