PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.126 of 2017 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners/accused, apprehending arrest at the hands of the respondent Police for the alleged offences punishable under Sections 436 IPC, in Crime No.126 of 2017, on the file of the respondent Police, seek anticipatory bail. 1/3
2. The case of the prosecution is that the son of the petitioner, while doing cleaning works in his agricultural field, collected the waste and set fire. The fire got spread in air and caused damage to some goods in the house of the defacto complainant. Initially, the respondent has registered a case in Crime No.126 of 2017 under Section 285 of IPC. Later, Charge Sheet was filed only against the petitioner by removing Section 285 of IPC and inducted Section 436 IPC.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent and she has not committed any such offences as alleged by the prosecution.
4. The learned Government Advocate (Crl.Side) would submit that only a summon is issued to the petitioner. Further, after completing the investigation, Final Report was filed in P.R.C.No.9 of 2022 before the concerned Court.
5. In view of the above said development and since summon is issued to the petitioner, let the petitioner appear before the concerned committal Court and execute bond under Section 88 of Cr.P.C. to the satisfaction and as required by the committal Court.

6. With the above said directions, this Criminal Original Petition stands disposed of.
