Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the Impugned notification sent by 3rd respondent based on the order given by 2nd Respondent in his proceedings Na. ka. Thi6/0903/2024 dated 12.08.2025 and quash the same as illegal and consequently direct the Respondents No. 1 and 5 to Petitioner's to continue petitioner Mayess Snacks Shop at Anbu Nagar, Nanjur, Keernur, Kulathur Taluk, Pudukkottai, based on the Petitioner's representation dated 25.07.2025 and 31.07.2025. ORDER

This writ petition has been filed challenging the impugned order dated 12.08.2025, whereby the second respondent directed the petitioner to shift his unit to some other place. The petitioner also seeks a direction to respondents 1 and 5 to permit him to continue his unit, namely Mayess Snacks Shop, situated at Anbu Nagar, Nanjur, Keernur, Kulathur Taluk, Pudukkottai District, based on his representations dated 25.07.2025 and 31.07.2025.

2. Heard the learned counsel for the petitioner, the learned Government Advocate appearing for the first respondent, and the learned Additional Government Pleader appearing for respondents 2 and 3. Perused the materials available on record.

3. The learned counsel for the petitioner would submit that the impugned order has been passed without affording notice or an opportunity of hearing to the petitioner.

4. The learned Additional Government Pleader appearing for respondents 2 and 3 also confirms the above position.

5. In view of the above submissions, this writ petition is allowed. The impugned order is set aside, and the matter is remitted back to the respondents. The second respondent is directed to pass a fresh order after issuing notice to the petitioner as well as to any interested parties, within a period of three months from the date of receipt of a copy of this order.
