ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for 1/4

the alleged offences under Sections 8(c) r/w. 20(b)(ii)(C) and Section 25, 29(1) r/w. 8 (c) r/w. 8(c) r/w. 20(b)(ii)(C) of the NDPS Act, in Crime No.282 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. Originally the final report was filed as against 11 accused persons. A1, A6, A7 and A9 under went trial in C.C.No.160 of 2023 and the case ended in acquittal by judgment dated 10.04.2024 by the learned Additional District and Sessions Court / Special Court of EC and NDPS Act Cases, Pudukkottai. Insofar as the petitioner, who is A3 and others the case was split up and is pending in C.C.No.172 of 2023. NBW was issued against the petitioner at the time of taking cognizance of the main police report that was filed by the respondent police.

3. Heard the learned counsel on either side and perused the material records of the case.

4. The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

5. Considering the undertaking given by the petitioner, the petitioner is directed to appear before the learned Additional District and Sessions Court / Special Court of EC and NDPS Act Cases, Pudukkottai, within a period of two weeks from the date of receipt of a copy of this order and file a petition to recall the NBW issued against him. 2/4

The concerned Court below is directed to consider the same on merits and pass orders on the same day.

6. The learned Trial Judge is directed to dispose of C.C.No.172 of 2023 within a period of 4 months from the date of receipt of a copy of this order.
