JUDGMENT
(Judgment of the Court was delivered by S.M.SUBRAMANIAM, J.) This Writ Appeal has been directed against the order dated 13.10.2023 passed in W.P.(MD)No.18824 of 2023.
2.The writ petitioner is the appellant and the Writ Petition was instituted challenging the tender notification issued by the Block Development Officer dated 30.06.2023 and for a direction to the 1st respondent to constitute block level committee as per the guidelines issued by the Government in G.O.(Ms)No.81, Rural Development and Panchayat Raj (S.G.S.1) Department, dated 13.06.2023. 3.The learned counsel appearing for the writ petitioner mainly contended that tender notification is for certain important works and therefore, constituting 2/6
block level committee including the writ petitioner, who is the Councillor, is of paramount importance for the purpose of providing better public services. 4.The learned Single Judge considered the submissions made between the parties and recording the undertaking given by the learned Additional Advocate General stating that G.O.(Ms)No.81, Rural Development and Panchayat Raj (S.G.S.1) Department, dated 13.06.2023 was issued after identifying works and after passing of the resolution by the Panchayat and the Block Level Committee will be constituted as per the guidelines issued in the said Government Order in respect of future works, disposed of the Writ Petition. 5.Further, in the counter affidavit filed by the 3rd respondent in the Writ Petition, it is stated as under:- "6.As per the District Collector's letter dated 17.12.
2022, the proposal for the works ascertained by the committee constituted as per the above said G.O., has to be sent to the District Collector. Thereafter, the works were laid before the Gram Sabha and resolution was also made 01.05.2023. Subsequently, the proposal along with Gram Sabha resolution was sent to the Collector on 19.06.2023 and the administrative sanction for 55 works valued at Rs.3,17,43,299/- was issued on 20.06.2023 in Na.Ka.No.A10/3775/2023 by the District Collector."
6.In view of the above facts and circumstances, the appellant could not able to establish any other additional grounds for the purpose of considering the present Writ Appeal. Therefore, the order impugned dated 13.10.2023 passed in W.P.(MD)No.18824 of 2023 stands confirmed. Accordingly, this Writ Appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
