O R D E R

The petitioner asserts that she is in continuous possession and enjoyment of land in survey No.401/9. Learned counsel for the petitioner submits that an Anganwadi building was constructed on her patta land and that she filled O.S.No.39 of 1999 before the Sub Court, Pudukkottai in respect thereof. After pointing out that the petitioner was successful before the Trial Court, he submits that the matter was remanded by the Second Appellate Court to the First Appellate Court and that the petitioner succeeded before the First Appellate Court. Meanwhile, he submits that the patta was cancelled and that the petitioner has applied for restoration of such patta.

2. Learned Government Advocate accepts notice on behalf of respondents 1 to 3. He submits that the petitioner's request for reissuance of patta would be considered and disposed of on merits within three 2/4

months from the date of receipt of a copy of this order.

3. In view of the above submissions of learned Government Advocate, without making any observations on the merits, this Writ Petition is disposed of by directing the third respondent to consider and dispose of the petitioner's request for reissuance of patta on merits within a period of three (3) months from the date of receipt of a copy of this order. While considering such request, the decree of the civil court may be taken into account. No costs.
