ORDER: The Court made the following order :- 1/4

The petitioner who was arrested and remanded to Judicial Custody on 13.02.2024 for the offences punishable under Sections 5(l), 5(m)r/w. 6 of POCSO Act, 2012 in Crime No.01 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on the date of occurrence when the victim girl was playing along with her friends the accused gave his phone to the victim to play games and picked the victim child into her house and committed sexual assault. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court and he is in judicial custody from 13.02.2024 and he would submit that the investigation has been completed and final report has been filed before the concerned Court. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that petitioner has committed sexual assault on five minor victims girls who are aged below 2/4

12 years, hence he opposed for grant of bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case and also taking in to consideration the gravity of offence committed by the petitioner against five minor victims who are below 12 years, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
