ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 13.08.2024, for the offences punishable under Sections 127(2), 118(1), 70(1), 351(3), 308(5), 76, 78 and 54 of BNS, 67A of IT Act, in Crime No.13 of 2024 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner and other accused persons had committed gang rape on the victim girl, assaulted her and took away her cell phone and gold chain. Hence, a case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He, however, submitted that the petitioner is willing to abide by any conditions that may be imposed by 2/5

this Court. Hence, he seeks bail.

4. The learned Additional Public Prosecutor submitted that the petitioner and other accused persons committed the aforesaid offences. However, he opposed to grant bail to the petitioner.

5.Taking into consideration the facts and circumstances of the case, and having regard to the nature of the offence, which is heinous against the victim and against the society, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original petition is dismissed.
