ORDER

This Criminal Original Petition is filed seeking to quash the FIR in Crime No.70 of 2025 on the file of the first respondent, which was registered for the offences under Sections 296(b), 118(1) and 351(3) of BNS, 2023.

2. The allegation in the FIR is that on account of prior enmity, the petitioner along with others abused the defacto complainant and his friends in filthy language; that they had attacked him with bricks and coconut leaf-stalk (thennai mattai) and threatened him of dire consequences and thus committed the aforesaid offences.

3. The learned Government Advocate (Crl. Side) would submit that there are totally four accused in this case; that since A3 and A4 are juveniles, final report was filed before the Juvenile Justice Board; and that they were acquitted.

4. Admittedly, the petitioner and the second respondent are known to each other and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 15.10.2025 and the scanned copy of the compromise memo reads as follows:

5. The defacto complainant is present before this Court in person and is identified by Mr.K.Rajagopal, Special Sub Inspector of Police, Madukkur Police Station, Thanjavur District. The defacto complainant confirms the compromise and would state that he does not wish to pursue the FIR as against all the accused.

In view of the same and considering the nature of the offences and the compromise arrived between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.70 of 2025 on the file of the first respondent is quashed as against all the accused and the Criminal Original Petition stands allowed. The petitioner shall pay a sum of Rs.5000/- (Rupees Five Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
