ORDER

The petitioners who are the accused in C.C.No.2057 of 2022 on the file of the learned Judicial Magistrate No.1, Tirunelveli have filed this petition to expedite the trial in the above calendar case pending on its file, on the ground that they are aged more than 67 years and the case has been pending from 2021 onwards.

2.There is a specific averment in the petition that earlier, this Court in Crl.O.P.(MD).No.20581 of 2023 directed the trial Court to dispose of the case, considering the continuous absence of the de-facto complainant: "3.Considering the request made by the learned counsel for the petitioners, let the above said trial process be completed within a period of five months from the date of receipt of a copy of this order."

3.Even after the direction issued by this Court, there was no compliance. Further, this Court also issued direction in W.P.(MD).No.22383 of 2024.

4. Considering the special circumstances of the case, this Court hereby directs the learned Judicial Magistrate No.1, Tirunelveli, to dispose of the trial in C.C.No.2057 of 2022 within a period of two months from the date of receipt of a copy of this Court.

5. With the above direction, this Criminal Original Petition stands disposed of.
