Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL UNDER SEC 438 OF CR.P.C. PRAYER :- For Anticipatory Bail in Crime No.97 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 354(A) and 506(i) IPC and Section 4 of Prohibition of Harassment of Women Act, 2002 in Crime No.97 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 02.08.2023 at 12.30 am, the petitioner herein has misbehaved with the defacto complainant's wife by touching her body and 1/3

pulled her hands. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and hence, seeks anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is working as SSI and due to the act of the petitioner, he was suspended from service and hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the serious nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
