ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/5
for the offences punishable under Section 108 of BNS, 2023 in Crime No.68 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is the wife of the deceased, one Chellandi. The said deceased Chelladi worked as a Clerk in M.D, SPL, 73 Nakkalapatti PACCB Society and the accused worked as an Appraiser in the above-mentioned society. In the meanwhile, the accused received duplicate jewels from 14 persons and pledged the same in their name and renewed the same. The deceased Chellandi, without knowing the said facts, signed the registration note and maintained the records. After knowing the real facts, the deceased questioned the same to the accused. At that time, the accused said that the deceased was responsible for the duplicate jewels. Due to the above said incident, the deceased committed suicide. Hence, a case has been registered against the petitioner.
3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner. 4.This Court already grant interim anticipatory bail and directed the 2/5
petitioner to appear before the respondent and cooperate with the investigation.
5. The learned Government Advocate (Criminal Side) strongly opposed to grant anticipatory bail to the petitioner stating that this is the third anticipatory bail petition. He submitted that after investigation, it is seen that the petitioner has misused the keys given by the deceased and has misappropriated the properties. He has also threatened the deceased that he is responsible for the misappropriation. Fearing the consequences of the same, the deceased has committed suicide.
6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
7. Accordingly, this Criminal Original Petition is dismissed. 14.11.2025 TMG 3/5
