Mr.S.Ravi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- To enlarge the petition on bail in connection with in C.C.No. 66 of 2024 on the file of the Additional District Judge/Presiding Office and Special Court for E.C. Act Cases, Thanjavur.

ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 06.11.2024 for the offences under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act and Section 328 BNS (hereinafter referred to as new penal code) in C.C.No. 66 of 2024, on the file of the learned Additional District Judge/Presiding Office and Special Court for E.C. Act Cases, Thanjavur in Crime No.138 of 2023 on the file of the respondent police, seeks bail.

2. Heard the learned Counsel appearing on either side. 3.In the instant case, there are totally four accused persons and the petitioner has been arrayed as A3. The FIR is of the year 2023 and the quantity involved in this case is 15.750 Kg of Ganja.

4.The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner was absconding and an absconding charge sheet was filed and the petitioner was able to be secured only after a non bailable warrant issued by the Court below. The petitioner is facing incarceration from 06.11.2024. 5.Considering the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to enlarge the petitioner on bail at this stage. There must be some progress in this case since there are three previous cases pending against the petitioner for similar offence.

6.In view of the above, this criminal original petition is dismissed for the present.
