Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to provide alternative light duty to the petitioner in the Mofussil North Branch, Madurai Region of first respondent such as desk duty during the day time forthwith along with attendant benefits including wages for the Non employment period commencing from 12.07.2024.

O R D E R

The instant writ petition has been filed by a Driver of the respondent Transport Corporation, seeking a mandamus to provide alternative light duty to the writ petitioner in view of his medical conditions.

2. It could be seen from the records that the writ petitioner has suffering from 'Colon Cancer' and he is undergoing Chemotherapy. The petitioner has given a representation on 08.11.2024, request the respondent Transport Corporation to refer him to the medical board.

3. Considering the above said facts, the respondents Transport Corporation are directed to refer the writ petitioner to Government Rajaji Medical College Hospital, Madurai to assess his endurance for performing duties of Driver. On the basis of the Medical Report, the respondents authorities are directed to pass appropriate orders in accordance with law. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs.
