ORDER
This writ petition has been filed to call for the records relating to the impugned order passed by the 1st respondent in his proceedings in Uni/3915/2023, dated 24.10.2024 and quash the same as illegal.
2. Heard the learned counsels on either sides and carefully perused the materials available on record.
3. The plight of the petitioner is that the petitioner is the elected vice president of Sasthavinallur Village Panchayat. Earlier the 1st respondent passed an order withdrawing the cheque signing power of the petitioner by an order dated 20.07.2023 without issuing a notice to him. Challenging the same, the petitioner filed a writ petition in W.P.(MD)No.19087 of 2023, in which, this Court by an order dated 26.06.2024 quashed the aforesaid order and remitted back to the 1st respondent for fresh consideration with a specific direction to give an opportunity of hearing before passing appropriate orders to the petitioner. However, the 1st respondent once again 2/4
passed the impugned order without giving an opportunity of hearing to the petitioner by passing the impugned order on 24.10.2024. 4.In view of the same, the impugned order is set aside and further remanded back to the 1st respondent, directing to pass appropriate orders after giving opportunity of hearing to the petitioner within a period of one (1) week from the date of receipt of a copy of this order.
5. Accordingly, the writ petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 29.11.2024 NCC : Yes / No Index : Yes / No Internet : Yes Sml Note: Issue order copy on 02.12.2024.
