ORDER : The Court made the following order :- The petitioner / Accused Nos.1 and 2, who were arrested and remanded to judicial custody on 28.10.2024 for the offence under Sections 281, 123 of BNS r/w Sections 6 and 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.284 of 2024 on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the accused persons (Accused Nos.1 and 2) were in possession of 584 kgs of banned tobacco products and they were carrying it in a vehicle. When the Police intercepted, they did not stop the vehicle and ultimately, the Police had chased the petitioners and get hold off them. There are totally three accused persons in this case and the petitioners have been arrayed as Accused Nos.1 and 2.

3. Taking into consideration the facts and circumstances of the case and considering the quantity of tobacco products that have been seized and also considering the fact that the petitioners belong to Rajasthan State and Accused No.3 is still absconding, this Court is not inclined to entertain this bail petition at this stage, since the investigation is at nascent stage.

4. In view of the above, the Criminal Original Petition is dismissed for the present.
