J U D G M E N T
[Judgment of the Court was made by DR.G.JAYACHANDRAN, J.] The award of the Labour Court, Tiruchirappalli, dated 21.12.2021, in I.D.No.58 of 2016, confirming the punishment of increment cut for a period of four years with cumulative effect imposed by the appellant herein on the first respondent herein, vide order dated 05.10.2013, has been interfered with by the learned Single Judge in the impugned order by reducing the punishment to that one of increment cut for a period of two years with cumulative effect.
2. The first respondent is a Conductor in the appellant - Transport Corporation. The charge framed against him is mis-appropriation of Rs.6/- by re-issuing the passenger ticket. The charge was proved against the first respondent and a punishment of increment cut for a period of four years with cumulative effect was imposed on him by the Disciplinary Authority and the same was confirmed by the Labour Court. Considering the quantum of mis-appropriation of funds i.e., Rs.6/- viz-a-viz. the punishment imposed on the first respondent, the learned Single Judge thought that it is shockingly disproportionate to the gravity of the charge proved against the first
respondent and it is on the higher side and hence reduced the punishment to that one of increment cut for a period of two years with cumulative effect. We find no ground to interfere with the order passed by the learned Single Judge, which has been passed taking into consideration the facts and circumstances of the case on hand and hence, we are not inclined to entertain this writ appeal.
3. Accordingly, this writ appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. [G.J., J.] [K.K.R.K., J.] 10.02.2026 NCC :
