ORDER

The present writ petition has been filed seeking to quash the order passed by the respondent herein, wherein the request of the petitioner to shift the service connection from one survey number to the adjacent survey number has been rejected.

2. The petitioner herein was provided with free agricultural service connection for S.No.122/9 in Service Connection No.488-001-2613 on 13.09.2023. The petitioner made an application on 06.10.2023 to shift the service connection from S.No.122/9 to S.No.144/4 which is an adjacent survey number.

3. According to the learned counsel appearing for the petitioner water is not available in S.No.122/9 therefore, he wants the service connection to be shifted to the adjacent land namely S.No.144/4. 2/4

4. Under the impugned order, the request of the petitioner has been rejected on the sole ground that his request of shifting of service connection cannot be made within a period of one year from the date of providing service connection.

5. A perusal of the record clearly reveal that the petitioner was given service connection on 30.09.2023 and already one year period has expired. Therefore, as on today, there is no legal impediment for the respondents to shift the service connection to S.No.144/4.

6. In view of the above said facts, the respondents are directed to shift the service connection on payment of necessary charges, within a period of four weeks from the date of receipt of a copy of this order.

7. The writ petition stands disposed of with the above observations. No costs.
