O R D E R

The issue that arises for consideration in this matter is that whether the proposal sent by the sixth respondent - School for appointing the petitioner as Vocational Instructor can be approved.

The respondents have relied upon G.O.(Ms) No.9, School Education (VE) Department, dated 06.01.2009, and would submit that as per the said Government Order, the post of Vocational Instructor has been abolished. Since the petitioner was appointed only after 06.01.2009 as a Vocational Instructor in the sixth respondent - School, the respondents have contended that the petitioner's case for seeking approval of the appointment cannot be granted in terms of the said Government Order in G.O.(Ms) No.9, School Education (VE) Department, dated 06.01.2009.

The main prayer sought for in the present writ petition was to quash the impugned order dated 17.06.2021, passed by the fourth respondent, rejecting the proposal sent by the sixth respondent - School seeking approval for the appointment of the petitioner as Vocational Instructor. Since the said Government Order in G.O.(Ms) No.9, School Education (VE) Department, dated 06.01.2009, which is the basis for rejecting the proposal sent by the sixth respondent - School, was not challenged earlier, the petitioner has now filed the present amendment application.

This Court is of the considered view that no prejudice will be caused to the respondents, if this amendment application is allowed without prejudice to the rights and contentions of the respondents to raise all the objections with regard to the amendment sought for through their additional counter affidavit to be filed before this Court in the main writ petition.

5. Accordingly, this miscellaneous petition is allowed as prayed for, without prejudice to the rights and contentions of the respondents to raise all the objections through their additional counter affidavit to be filed before this Court in the main writ petition.
