ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w. 20(b) (ii) (B) of NDPS Act, 1985 in Crime No.413 of 2022 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the petitioner along with other other accused were illegally found in possession of 1.300 Kilograms of Ganja. Hence, the complaint.

3.The learned Counsel for the Petitioner would submit that the Petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and thereby, seeks anticipatory bail. https://www.mhc.tn.gov.in/judis

4.The learned Government Advocate (Crl. Side) would submit that the petitioner is a habitual offender and that there is one previous case against him in similar nature and he is doing the business of selling Ganja and hence, he strongly opposes to grant anticipatory bail to the petitioners.

5. Taking into consideration of the facts and circumstances of the case and that the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner.
