ORDER : The Court made the following order :- The petitioner / Accused who was arrested and remanded to judicial custody on 19.06.2025 for the offences punishable under Sections 9(m), 9(s) r/w 10 and Section 18 of POCSO Act, 2012 and r/w Section 10 and 18 of POCSO Act, 2012 and 3(1)(r), 3(2)(va), SC/ST, 1989, in Crime No.4 of 2025 on the file of the respondent police, seeks bail,

2. The case of the prosecution is that the petitioner had taken the victim child to the motor pump set and, thereafter, he sexually harassed her. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that due to money dispute, a false case has been given. He would further also submit that the petitioner is ready and willing to abide by any conditions that my be imposed by this Court and he is in judicial custody from 19.06.2025. Hence, he seeks bail.

4. The learned Government Advocate (Criminal Side) would submit that the petitioner had sexually harassed the child and her mother. He would further submit that the investigation has been completed and the charge sheet has also been filed. However, he objected to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and on perusal of the 164 statements, it is revealed that the petitioner is involved in a very serious offence. If the petitioner is released on bail, he will tamper with the witnesses and abscond. Therefore, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 24.10.2025 msrm 3/5
