ORDER

This is a petition seeking initiation of contempt proceedings against the Respondent for violation of the order, dated 18.06.2024 passed by this Court in W.P.(MD)No.23407 of 2022.

2. Heard Mr.A.Ajith Geethan, learned counsel, for Mr.E.V.N.Siva, learned counsel, for the Petitioner and Mr.F.Deepak, learned Special Government Pleader for the Respondents.

3. Mr. A. Ajith Geethan, the learned counsel for the petitioner, submits that in compliance with the order dated 18.06.2024 passed by this Court in W.P.(MD)No.23407 of 2022, wherein a direction was given to "the 3rd Respondent / the Chief Educational Officer, Kanyakumari District at Nagercoil to pass orders granting approval for the appointment of A. Benila Hann as P.G. Assistant (Maths) in the Petitioner School with effect from 13.06.2017 within a period of four weeks from the date of receipt of a copy of this order", the respondent has complied with the order dated 18.06.2024 passed by this Court through the order dated 03.02.2025.

Mr.F.Deepak, the learned Special Government Pleader, produced an order dated 03.02.2025, passed by the respondent/the Chief Educational Officer, Kanyakumari District at Nagercoil, before this Court. He submits that the respondent has made full compliance with the order passed by this Court on 18.06.2024 in W.P.(MD)No.23407 of 2022. A copy of the order has also been taken on record. Therefore, he prays that the Respondent be discharged from the contempt proceedings.

The learned counsel for the Petitioner submits that the direction issued by this Court vide order dated 18.06.2024 has been fully complied with by the Respondent, the Chief Educational Officer, Kanyakumari District at Nagercoil, on 03.02.2025, and that in this regard, an order has also been issued, which was received by the Petitioner. He further states that he has no objection to the Respondent being discharged from the contempt proceedings.

6. The learned counsel for the Petitioner further submits that the Respondent may also be directed to pay the salary and other benefits to the Petitioner forthwith.

7. The learned Special Government Pleader submits that once an order has already been passed by this Court, it is the duty of the Respondents to 3/5

comply with the order, and thereafter, the Respondents may certainly consider the claim of the Petitioner in respect of salary and other monetary benefits from the date of approval.

In view of the submissions made by the learned counsel for the Petitioner and the learned Special Government Pleader and after perusal of the order dated 03.02.2025 passed by the Respondent which was passed in compliance with the order dated 18.06.2024 in W.P.(MD)No.23407 of 2022, the Respondent is discharged from the contempt proceedings. Accordingly, the Contempt Petition is disposed of. The file shall be consigned to record. No costs.
