ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under section 379 I.P.C., @ into Sections 379 and 392 IPC in Crime No. 230 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner herein and other accused have snatched 5 sovereigns of gold chain belonging to the defacto complainant. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. He further contended that based on the confession of co-accused only the petitioner herein is arrayed as accused and hence, seeks anticipatory bail.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner herein and other accused have snatched 5 sovereigns of gold chain belonging to the defacto complainant and the petitioner herein was arrayed as 2/3

accused based on the confession of co-accused. He further contended that A2 has already been arrested and the investigation of the case is pending and hence, strongly objected for granting anticipatory bail to the petitioner.

5. Considering the serious nature of allegations made against the petitioner and that the property has not been recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
