2025/0103/23/259905TR dated 26.06.2025 and quash the same as illegal and consequently, direct the third respondent to restore the Patta in the name of Alagappan, S/o.Alagappan.

ORDER

This Writ Petition has been filed seeking to quash the impugned orders of the third respondent dated 23.06.2025 and 26.06.2025, and consequently, to direct the third respondent to restore the Patta in the name of Alagappan, S/o.Alagappan.

2. Heard the learned counsel appearing for the parties.

3. The narration of the facts of the present case is not necessary, since the only ground raised by the learned counsel for the petitioner for setting aside the impugned orders is that the petitioner was not put on notice, though he is one of the descendants of the original owner of the property, namely Alagappan.

4. This Court, on 18.09.2025, granted an order of interim stay of the impugned orders on the ground that a prima facie case had been made out to show that the petitioner was not given notice before passing the impugned orders.

5. Considering the aforesaid facts and circumstances of the case, the impugned orders are set aside, and the matter is remitted back to the third respondent / Tahsildar, who shall hear the matter afresh and, after affording an opportunity to the petitioner as well as the respondents 4 to 6, pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. Needless to say, all interested parties shall be put on notice during the enquiry, and the enquiry shall thereafter be conducted.

6. Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No 10.12.2025 smn2
