The learned counsel for the petitioner after making submissions for some time sought permission of this Court to withdraw this Criminal Original Petition and he has also made an endorsement to that effect.

2. However, the learned counsel for the petitioner requests that the personal appearance of the petitioner before the Trial Court may be dispensed with as he is employed.

3. In view of the above, the Criminal Original Petition is dismissed as withdrawn. The petitioner's personal appearance before the Trial Court is dispensed with except when his appearance is required by the learned Judicial Magistrate for the progress of the trial. If the petitioner fails to comply with any direction of the learned Magistrate to appear, the order passed by this court will lose its efficacy.
