O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the third respondent to consider the representation dated 16.10.2023 of the petitioner.

2. Heard the learned counsel for the parties and perused the materials available on record.

3.The learned counsel appearing for the petitioner submits that, pursuant to an application made by the fourth respondent seeking transfer of the patta in his name and in view of the fact that a civil suit in O.S. No. 68 of 2020 is pending adjudication, the petitioner made a representation dated 16.10.2023 seeking dismissal of the application filed by the fourth respondent. Since no action has been taken by the respondents on the said representation, the present writ petition has been filed.

4. The learned Government Advocate appearing for respondents 1 to 3 submits that, although a civil suit is pending between the parties, the petitioner's representation will be considered and disposed of, by the 2/5

second respondent, in accordance with law after considering the claims of all parties.

In view of the above submissions, this Court directs the second respondent to consider and dispose of the petitioner's representation dated 16.10.2023, on merits and in accordance with law, after taking note of the civil court proceedings. Notice shall be issued to the petitioner, the fourth respondent and other persons interested in the subject land and appropriate orders shall be passed on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. Any changes in the patta shall be made subject to the outcome of the petitioner's representation. In the event of any rival claims, the same can be agitated before the competent civil court.
