Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 4th respondent to conduct the auction for the shops situated at the Thirumangalam Bus Stand and outside of the Weekly Market, Thirumangalam to be held on 27.11.2024 as per the Re-auction notification issued by the 4th respondent dated 11.11.2024, in a fair and transparent manner by appointing an Advocate Commissioner. ORDER
The present writ petition has been filed seeking to direct the 4th respondent to conduct the auction for the shops situated in Thirumangalam Bus Stand and outside the Weekly Market, Thirumangalam, which is scheduled to be held on 27.11.2024 as per the re-auction notification issued by the 4th respondent, dated 11.11.2024, in a fair and transparent manner by appointing an Advocate Commissioner.

2.By consent of both parties, considering the limited relief sought for by the petitioners, the Writ Petition is taken up for final disposal at the stage of admission itself.
3.Heard, the learned counsel appearing for the petitioners, the learned Government Advocate appearing for the respondents 1 to 3 and the learned Standing Counsel appearing for the 4th respondent. Perused the materials on record.
4.On perusal of records, I do not find any necessity for appointing an Advocate Commissioner for conducting auction of the shops situated in Thirumangalam Bus Stand and outside the Weekly Market, Thirumangalam, which is scheduled to be held on 27.11.2024 in a fair and transparent manner. The 4th respondent has to exercise his statutory duty diligently in a straight forward and transparent manner.
5.In view of the above, the 4th respondent is directed to conduct auction on 27.11.2024 in a fair and transparent manner. With the above 3/5
