Heard the learned counsel on either side.
2. The petitioner feels aggrieved by the execution of the sale deed No.133 of 2009 on the file of the third respondent. He submitted a representation on 20.07.2020. The second respondent relegated the petitioner to move the jurisdictional civil Court. Questioning the same, the petitioner filed an appeal before the first respondent. The appeal also has been disposed of on 10.02.2022. In the meanwhile, 2/5
3 W.P.(MD)NO.28814 OF 2022 subsequent transactions have been taking place. The petitioner has once again submitted representation before the authorities and he wants this Court to give a disposal of the same.
3. As rightly pointed out by the learned Additional Government Pleader, the petitioner cannot vex the authorities by submitting successive representations. Once the petitioner is unsuccessful, he must pursue his remedy before the appropriate forum. He cannot submit one representation after another and come to this Court for directing the authorities to dispose of them. I make it clear that the petitioner has to either file a civil suit or question the rejection orders. Issuance of writ of mandamus will not lie. This writ petition stands dismissed as not maintainable. It is made clear that I have not pronounced anything on the merits of the matter. No costs. 05.01.2023 NCS : Yes / No Index : Yes / No Internet : Yes/ No PMU 3/5
