ORDER

This petition has been filed to quash all further proceedings of the impugned summon dated 11.11.2024 on the file of the first respondent Police issued against the petitioners.

2.The case of the prosecution is that the second petitioner is the son of the first petitioner. The Petitioners 3 and 4 are the husband and wife. The fifth petitioner is the friend of the first petitioner. The second respondent gave a complaint to the first respondent police regarding the properties situated at Villupatti and Adakam Village of Kodaikanal Taluk, as if the signature of the second respondent was forged and an application was made to RDO for mutation of revenue records and for the alienation of properties that stood in the name of the second respondent. Based on which, the first respondent had issued the summons against the petitioners, dated 11.11.2024 calling the petitioner to attend for enquiry before the first respondent on 16.11.2024 under Section 91(1) of Cr.P.C.. Challenging the same, the present petition is filed.

3 Crl.O.P.(MD) No.21127 of 2024 3.The learned Government Advocate (Crl. Side) appearing for the first respondent Police submitted that as per the direction of the Superintendent of Police, Dindigul, Dindigul District, in G3/187/SPCamp/DG/2024, dated 28.10.2024, the first respondent police acted on the complaint given by the second respondent and registered a case in Crime No.18 of 2024, against the petitioners, for the offence under Sections 465, 468 and 120B of IPC.

4.Recording the same, this Criminal Original Petition is closed. The petitioners are permitted to file appropriate petition before the appropriate Court challenging the same.
