ORDER
The above writ petition is filed seeking a direction to the respondents to issue passport to the petitioner, by considering his passport application dated 07.08.2025.
2. The petitioner would submit that he is a daily wage earner and in order to better his income, he had decided to go abroad. Consequently, he applied to the respondents for issuance of passport vide A.No.MD-2065459530625 dated 07.08.2025. The 1st respondent thereafter had issued a communication dated 01.09.2025 informing the petitioner that a criminal case was pending against him in Cr.No.109 of 2022 on the file of the 3rd respondent police station for which the case has been registered under Section 153(A), 505 and 505(1)(b) of IPC. The petitioner was directed to appear before the authorities with the requisite documents. The petitioner would submit that he had appeared before the respondent 2/4
and submitted his explanation. However, the respondent had not issued passport till date. Therefore, the petitioner has come forward with the present writ petition.
3. Today when the matter had come up for admission, Mr.S.Prakash, learned Government Advocate (Crl.Side) appearing on behalf of the 3rd respondent would submit that FIR lodged against the petitioner has been dismissed as mistake of fact.
4. Considering the fact that there is no impediment now in the form of criminal complaint or otherwise against the petitioner, it is open to the 1st respondent to process the petitioner's application and issue passport. The said exercise shall be completed within a period of three (3) weeks from the date of receipt of a copy of this order.
5. With these observations and directions, the writ petition stands allowed. No costs.
