********** This Writ Petition is filed for a Writ of Mandamus directing the first respondent to conclude the enquiry in his proceedings in NO.A1-7398/2024, dated 4.11.2024 so as to cancel the patta vide patta No.5556 standing in the name of the third respondent with respect to S.No.749, situate at Kottaiyur Village, Watrap Taluk, Virudhunagar District within the time frame fixed by this Court. 2.Mr.A.Kannan, learned Additional Government Pleader takes notice for the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.Aggrieved by the issuance of patta in favour of third respondent in Patta No.5556, the Petitioner has filed the above Writ Petition. The Petitioner preferred an appeal before the first respondent challenging the patta issued in favour of third respondent on 04.11.2024. Though enquiry was conducted in pursuance of the Petitioner's appeal, dated 04.11.2024, the same was not taken to a logical end.Therefore the Petitioner filed the
above Writ Petition for the aforesaid relief. 4.Admittedly, in the Petitioner's appeal, dated 4.11.2024, enquiry proceedings were inititiated and the same is pending before the first respondent.
5.Under these circumstances, without going into the merits of the case, I deem it appropriate to direct the first respondent to conclude the enquiry in the proceedings inititiated in the Petitioner's appeal, dated 04.11.2024, and pass orders on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
