Side) For de-facto complainant: Ms.K.Vidya ORDER : The Court made the following order :- This petition has been filed to set aside the impugned order in Crl.M.P.No.1903 of 2025 dated 09.09.2025 passed by the learned Principal Sessions Judge, Theni, and extend the time for two weeks to produce the sureties in Crl.M.P.No.1292 of 2025. 2.The learned counsel for the petitioners submitted that the petitioners filed an anticipatory bail application before the learned Principal Sessions Judge, Theni, in Crl.M.P.No.1292 of 2025 and the learned Sessions Judge vide order dated 25.06.2025 granted anticipatory bail to the petitioners and directed the petitioners to deposit a sum of Rs.35,000/- to the credit of Crime No.146 of 2025 and also directed the first petitioner to appear and report before the respondent Police weekly 2/6

twice on every Monday and Friday at 10.00 a.m., for a period of 18 weeks and the second petitioner appear and report before the respondent Police daily at 10.00 a.m., for a period of 30 days. He further submitted that unfortunately, the petitioners' close relative was died and thereby, they are unable to produce the sureties in time. Thus, they had filed an extension of time petition in Crl.M.P.No.1903 of 2025 before the learned Principal Sessions Judge, Theni and the same was dismissed on 09.09.2025. Hence, the present petition is filed. 3.Ms.K.Vidya, learned counsel appearing for the defacto complainant has opposed to allow this petition.

4. The learned Government Advocate (Criminal Side) appearing for the respondent has not raised any objection to allow this Criminal Original Petition.

5. Considering the submissions made by the learned counsel for the petitioners, and being satisfied with the reasons stated above, this Court is inclined to allow this petition with the following directions: 3/6

5.1.The impugned order in Crl.M.P.No.

1903 of 2025 dated 09.09.2025 passed by the learned Principal Sessions Judge, Theni, is set aside.

5.2.The petitioners are directed to surrender and produce two sureties each before the learned Jurisdiction Magistrate, Uthampalayam within 15 days from the date of receipt of a copy of this order.

5.3.Since the first petitioner is a practicing advocate, he shall maintain dignity in his profession and not indulge in any activities that would affect the profession.
