Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to consider the petitioner's representation dated 21.10.2024 seeking action against the second respondent under Sections 81 and 83 of the Registration Act, 1908. ORDER

Without expressing any opinion on the merits of the writ petition, the first respondent is directed to conduct an enquiry after issuing notice to the petitioner as well as counter parties after giving opportunity of hearing and pass orders within a period of twelve weeks from the date of receipt of a copy of this order.

2. It is made clear that the second respondent is nothing to do for registering the document, which was presented by the counter parties on the strength of the legal heir certificate, dated 23.02.2024. Subsequently, the said legal heir certificate was cancelled by the revenue authority on the appeal filed by the petitioner dated 16.10.2024. Therefore, the second respondent is nothing to do for registration.

3.With the above said directions, this writ petition stands disposed of. No costs.
