O R D E R
The petitioner has filed this writ petition to direct the 3rd respondent police to consider the petitioner's representation dated 07.10.2024 to handover the petitioner's two-wheeler vehicle bearing No.TN-45-BT-0784 to the petitioner within the time fixed by this Court. 2.The petitioner is the accused in Crime No.39 of 2024 on the file of the District Crime Branch, Tiruchirappalli. In the said case, there was an allegation against the petitioner that he cheated number of people. Pending investigation before the District Crime Branch, the third respondent police took away the vehicle/two-wheeler bearing No.TN-45BT-0784 and directed him to give the amount to the complainant in the above-said crime. Therefore, they kept the vehicle in illegal custody, and hence, the petitioner filed a petition for Mandamus directing the third respondent to consider his representation dated 07.10.2024 and hand 2/5
over his vehicle .
3.When this case was listed for hearing, this Court directed the Inspector of police to appear before this Court. The Inspector of Police appeared and stated that there was no case pending against him and they were ready to hand over the vehicle.
4.Therefore, this Court reserved this matter for orders and directed the learned Additional Public Prosecutor to submit the report regarding the handing over of the vehicle. The learned Additional Public Prosecutor submitted the resport stating that the vehicle was handed over to the petitioner and the petitioner also received the same. 5.Recording the same, this writ petition stands closed. There shall be no order as to costs.
