ORDER : The Court made the following order :- The petitioners/accused Nos.2 and 4, who apprehend arrest at the hands of 1/3

the respondent police for the offences punishable under sections 498(A), 494 IPC, Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 2002 and Section 4 of the Dowry Prohibition Act, 1961 Crime No.7 of 2024 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the first accused married to the defacto complainant in the year 2019 and there was a male child out of the wedlock. The grievance of the defacto complainant is that the first accused got married to another woman and the defacto complainant was treated with cruelty by the in-laws. 3.Heard the learned counsel appearing for the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent Police submits that there are totally four accused persons in this case and the petitioners are arrayed as A2 and A4, who are the mother-in-law and fatherin-law of the defacto complainant. 5.Taking into consideration the facts and circumstances of the case and also considering the fact that there is a matrimonial dispute and the custodial 2/3

interrogation of the petitioners (A2 and A4) will not be required in this case, there shall be a direction to the respondent police to resort to the procedure adumbrated under Section 35 of the BNSS Act and complete the enquiry as expeditiously as possible.
