PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to remove the encroachment the patta No.1858 in Survey Number 178, 179, 180 and 181 at Gangainagar, Nilaiyur Pit 2, Madurai by considering the petitioner's appeal complaint through 'Muthalvarain Mugavari Thurai' the App from 'TN CM Helpline Citizen' dated 02.01.2025 numbered as Rev TN/REV/MDU/P/Portal/02 JAN25/10739785.

ORDER

(Order of the Court was made by DR.ANITA SUMANTH, J.) Petitioner's prayer is for a mandamus, directing the District Collector, Madurai to consider his appeal filed through Muthalvarain Mugavari Thurai, 'TN CM Helpline Citizen' App, dated 02.01.2025 numbered as Rev TN/REV/MDU/P/Portal/02 JAN25/10739785 and to remove the encroachment on patta No.1858 in S.Nos.178, 179, 180 and 181 at Gangainagar, Nilaiyur Pit 2, Madurai.

2. Mr.M.Sarangan, learned Additional Government Pleader, who appears for respondents 1 to 4, being the official respondents, has instructions, to convey that the survey numbers mentioned in the prayer relate to patta lands.

3. However, rather than going into the merits of the matter, since the petitioner has made a complaint to the State, let his representation dated 02.01.2025 be considered by R1 and disposed in accordance with law, after hearing the petitioner as well as R5 by issuing prior notice. This exercise shall be completed within a period of four weeks from date of receipt of a copy of this order.

4. With the above direction, this writ petition stands disposed. No costs.
