PRAYER :- For Bail in Crime No.1015 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 14.12.2022 for the offence under Sections 451, 342, 392 and 397 IPC in Crime No.1015 of 2022, seeks bail. 2.The case of the prosecution, as per the de-facto complainant, is that she is residing at door No.25, Sundar Nagar 7th Cross Street, K.K.Nagar, Trichy and that on 18.10.2022, the person aged about 45 years claiming himself to be one Rajesh, had come to her house in the guise of taking the upstairs portion for rent and she had allowed him inside and the accused, after coming into the house, had threatened her with a knife and had robbed six sovereigns of gold chain and two bangles from her and pushed her into the room and locked the room and escaped from the scene of occurrence. Hence, the case came to be registered.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and a false complaint has been registered against him and thereby, he would seek for bail. 4.The learned Additional Public Prosecutor would submit that the petitioner is a habitual offender, he had in the guise of taking a house on rent, entered into the house and after threatening the house owner with a knife, had robbed six sovereigns of gold chain and two bangles and later, he pushed the lady into the room and https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.22801 of 2022 locked the room and escaped from the scene of occurrence. He would further submit that the petitioner has been arrested only on 14.12.2022 and the case is at the very nascent stage of investigation. He would further submit that the petitioner has several similar cases to his credit and he has involved in Crime No.941 of 2021 registered by the C1 Kattur Police Station, Coimbatore for the offence under Section 386 IPC; Crime No.233 of 2022, registered by E2 Peelamedu Police Station, Coimbatore for the offence under Section 392 r/w 397 IPC; and Crime No.758 of 2021, registered by C2 Race Course Police Station, Coimbatore for the offence under Section 379 IPC. He would further submit that the identification parade has to be conducted and he would vehemently oppose for grant of bail.

5.Heard. Perused the materials available on record including the FIR.

6.Taking into consideration the nature and gravity of the offence and that the petitioner is a habitual offender, against whom, there are three similar cases of property offence, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed for the present.
