Respondents PRAYER :- This Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the third respondent to register a case as per the complaint dated 14.08.2025 thereby implementing the order of the Judicial Magistrate, Sankarankovil in Crl.M.P.No.1220 of 2023, Crl.M.P.No.258 of 2024 and Crl.M.P.No.169 of 2025 in accordance with law within a stipulated time fixed by this Court.

ORDER

The petitioner seeks for a Writ of Mandamus seeking a direction to the third respondent to register a case as per the complaint dated 14.08.2025 thereby implementing the order of the Judicial Magistrate, Sankarankovil in Crl.M.P.No.1220 of 2023, Crl.M.P.No.258 of 2024 and Crl.M.P.No.169 of 2025 in accordance with law within a stipulated time fixed by this Court.

According to the learned counsel for the petitioner, the learned Judicial Magistrate by order dated 04.04.2025 had directed the Deputy Superintendent of Police, Sankarankovil, Tenkasi District, to enquire into the conduct of the Station Officer and to file a report; that the respondents have not complied with the said direction; and that since the learned Magistrate has now been transferred, the respondents are not taking any action.

3. It is needless to state that the respondents are bound by any direction issued by the learned Magistrate. However, this Court is of the 2/5

view that the petitioners can approach the learned Magistrate if his/her order has not been complied with.

4. It is also reported that the petitioners have also filed Crl.M.P.No. 14 of 2025 for implementing the order and it is still pending. The learned Judicial Magistrate, Sankarankovil, may consider the said petition in accordance with law and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
